The Request for a Discontinuance Order Without a Hearing is the Ontario Landlord and Tenant Board (LTB) form a landlord files after a tenant has paid off an L1 application before the LTB issues an eviction order. The form also contains a draft order. If you complete it correctly, an LTB Member will usually sign the order and close the file, and nobody has to attend a hearing. The form's own instructions call it the Request for Ex Parte Discontinuance Order.

What the form is for
Under s. 74(2) of the Residential Tenancies Act, 2006 (RTA), an L1 eviction application based on an N4 shall be discontinued if, before the Board issues the eviction order, the Board is satisfied that the tenant has paid to the landlord or to the Board:
- the rent that is in arrears;
- the additional rent that would have been due as of the date of payment if the notice of termination had not been given; and
- the landlord's application fee.
Once that happens, the tenant cannot be evicted on that application, even if they fall behind again later. The form is your declaration that the payment was made, so a Member can issue the s. 74(2) order without a hearing.
If the tenant pays into the LTB instead, you file nothing: under Rule 20.1 the LTB pays you out and discontinues the application itself.
When to use it (and when not to)
Use it when the tenant has paid you, directly, the full s. 74(2) amount after you filed the L1 and before an order issued.
Do not use it when:
- The tenant paid only part. Partial payment does not discontinue an L1. Update the amount owing for the hearing with the L1/L9 Information Update.
- An eviction order has already issued. Payment may then void the order under s. 74(4), a different process and amount.
- The application is an L2 or L9. This form is for the L1 only. To drop other applications, use the Request to Withdraw an Application.
How to pick the discontinuance date
The form asks for the date "ending on" which the tenant paid all rent owing. The instructions say to use the last day of the rental period in which the tenant paid:
- Monthly tenancy, rent due on the 1st: the tenant pays on January 10, so the date is January 31.
- Mid-month tenancy: periods run, for example, February 15 to March 14. The tenant pays March 7, so the date is March 14.
The instructions' worked example: $1,000 monthly rent unpaid for January to March, and a $186 filing fee. A payment of $4,186 on April 10 (arrears, April's rent and the fee) discontinues the application for the period ending April 30.
How to fill out the form, section by section
The PDF has two parts, and the instructions say you must complete the fillable fields in both.
The Request
- Your name, confirming you are the landlord (or its legal representative) and filed the L1, and the L1 file number.
- The date the tenant's payment covers rent to (the discontinuance date above). This paragraph also confirms that the tenant paid all rent arrears, all new rent owing and the filing fee.
- The solemn declaration. You confirm the information is true and acknowledge that providing false or misleading documents to the Board is an offence.
- Tick Landlord or Landlord Representative. Add the declarant's name, signature and date (dd/mm/yyyy).
The Order (s. 74(2))
- The file number, the rental unit address, the landlord's name and the tenants' names, exactly as on the L1.
- In paragraph 1, the same "period ending on" date you used in the request.
- Leave blank the "Date Issued" and "Member, Landlord and Tenant Board" lines. A Member completes those.
Filing it
The LTB's forms page lists the Tribunals Ontario Portal. Lawyers and paralegals must file this form through the Portal. The LTB will not process it if they send it any other way. There is no fee. If the form is complete and correct, the LTB will usually issue the order without a hearing and send it to all parties.
Mistakes that get it refused or delayed
- Signing before the money has cleared. If the payment later fails, you have made a false declaration and closed your own file.
- Using the wrong date. The payment date instead of the end of the rental period, or a date that does not match the amounts, makes the request inconsistent with s. 74(2).
- Leaving the order portion blank, or filling in the Member's lines. The instructions require the landlord to complete the order fields and leave the Date Issued and Member lines alone.
- Accepting less than the full amount. Without the fee and the current period's rent, the application is not discontinued; signing anyway closes a file you could have pursued.
- Wrong file number, or names that differ from the L1. The order is issued on your draft, so errors carry into it.
- Using it after an eviction order issued. That is a voiding question under s. 74(4).
What happens next
If the request is in order, a Member signs the discontinuance order, no hearing is held, and the file closes. If the tenant falls behind again, you need a fresh N4.
Recent changes
Section 74(2) did not change with Bill 60. But an N4 given on or after September 21, 2026 gives 7 days' notice, not 14, and the N4 and L1 were updated that day. Previous versions of the L1 will no longer be accepted as of November 30, 2026. The LTB's update does not name the N4 in that cut-off, so simply use the current N4. The form's worked example ("15 days after" an N4) predates the change.
Frequently asked questions
What does a tenant have to pay to stop an L1 eviction application?
All rent arrears, the rent that would have come due up to the date of payment, and the landlord's application fee. The payment must be made to the landlord or the LTB before the eviction order issues (RTA s. 74(2)).
Do I need a hearing to discontinue my L1?
Usually not, if the request is complete and correct.
Do NSF charges have to be paid for a discontinuance?
No. Section 74(2) lists only arrears, rent owing to the payment date and the fee. NSF charges count when voiding an order (s. 74(4)).
The tenant paid the LTB, not me. What do I file?
Nothing. Under Rule 20.1 the LTB pays out the required amount to you and discontinues the application itself.
