1) Acceptance

The Site is maintained by Ian Shemesh, Paralegal ("Ian Shemesh, Paralegal"). The Site provides information, data, articles, publications, and other materials accessible to the general public (the "Content"). Your access to and use of the Site is subject to these terms and conditions (the "Terms"). By accessing or using the Site, you agree to be bound by these Terms, which form a legal agreement between you and Ian Shemesh, Paralegal. If you do not agree, do not use the Site.

Changes. We may revise these Terms at any time without notice. Your continued use of the Site after changes are posted signifies acceptance of the revised Terms.

3) No Paralegal–Client Relationship

Accessing, using, or relying on the Content does not create a paralegal–client relationship between you and Ian Shemesh, Paralegal or any member of the firm. Communications sent via the Site or by email do not create such a relationship. Internet communications are generally not secure; we cannot guarantee the security or privacy of any communication sent to or from the Site.

4) Communications Not Confidential

Ian Shemesh, Paralegal does not guarantee the confidentiality of communications made by you via email or through the Site, and cannot guarantee such communications are protected by solicitor–client privilege. To share confidential or sensitive information, please contact us by telephone.

5) Ownership of Content

All Content—including designs, text, graphics, software, artwork, videos, photos, trademarks, logos, and other marks—is owned by Ian Shemesh, Paralegal and/or its licensors, or the party credited as the provider, and is protected by intellectual property laws. Except as permitted under the limited licence below, any reproduction, modification, distribution, republication, or other exploitation of the Site or Content, in whole or in part, is prohibited without our prior written consent.

6) No Unlawful Use & Limited Licence

You agree not to use the Site for any unlawful purpose. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access, view, and use the Site for personal, non-commercial purposes, including downloading, storing, and printing single copies of Content for personal, non-commercial use, provided all copyright and other notices are retained.

Information sent or received over the Internet is generally not secure. Ian Shemesh, Paralegal cannot guarantee the security of any communication to or from the Site and assumes no responsibility or risk for your use of the Internet.

9) Privacy Policy

Any personal information submitted through the Site will be treated in accordance with our Privacy Policy, as amended from time to time. Please review it frequently. Our Privacy Policy applies only while you are using the Site. When you follow a link to another website, review that website's privacy policy before providing personal information.

10) Disclaimer & Limitation of Liability

The Site and Content are provided on an "as is" and "as available" basis, without any warranty or condition of any kind, express or implied. Ian Shemesh, Paralegal expressly disclaims all warranties and conditions, including implied warranties of security, accuracy, reliability, accessibility, merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the Site is free from viruses, malware, worms, or other harmful components. Use of the Site is at your own risk.

Subject to applicable law, in no event shall Ian Shemesh, Paralegal or its partners, employees, consultants, agents, or licensors (the "Released Parties") be liable for any damages of any kind, including direct, special, indirect, punitive, incidental, or consequential damages (including lost business, savings, data, or profits) arising from or related to your use of, reliance upon, or inability to use the Site or Content, whether based in contract (including fundamental breach), tort (including negligence), or otherwise, even if advised of the possibility of such damages.

11) Release & Indemnity

You release the Released Parties from any and all liabilities and damages arising from your use of the Site or Content. Your sole remedy is to cease using the Site. You agree to indemnify and hold the Released Parties harmless from any claims, losses, judgments, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Site or Content, or any breach of these Terms, including third-party claims arising out of your use of Content.

12) Governing Law & Jurisdiction

The Site is operated from Ontario, Canada. All matters relating to your access or use of the Site and Content, or to these Terms, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding conflict of laws principles. You submit to the non-exclusive jurisdiction of the courts of Ontario.

13) Termination

Ian Shemesh, Paralegal may, in its sole discretion, cancel or terminate your right to use the Site (in whole or in part) at any time without notice. Upon termination, you are no longer authorized to access the affected portions of the Site. The restrictions regarding the Site and Content survive termination. We are not liable to any party for termination.

14) General

Except for any specific agreement in respect of Content or supplemental terms made available on the Site, these Terms constitute the entire agreement between you and Ian Shemesh, Paralegal regarding your use of the Site and Content. If any provision is held invalid, it shall be severed and the remaining provisions shall remain in full force. You may not assign your rights or obligations under these Terms. No waiver is effective unless in writing and signed by Ian Shemesh, Paralegal. Headings are for convenience only and have no legal effect.
